Official Rules and Regulations
Raffle tickets are offered for $50 per ticket plus a $2.25 processing
fee and are obtainable through this website.
By entering into this game of chance all entrants agree to be fully
and unconditionally bound by these official rules and regulations,
waive any right to claim ambiguity in the raffle or these official
rules and regulations and further agree to be bound by the sponsors
decisions and interpretation of these official rules and regulations.
By entering all entrants release the participating sponsors and providers
and any of their respective parent companies, subsidiaries or affiliates,
directors, officers, employees and agencies from any and all liability.
ELIGIBILITY
Drawing open only to residents of the United States who are 18
years of age or older at the time of entry, to obtain a ticket,
or be a ticket holder or to win the prize. An affidavit of eligibility,
photo identification, taxpayer identification number and other
information will be required of the raffle winner.
Void where prohibited.
This is not a lottery; this is a drawing by chance. All applicable
federal, state and local laws and ordinances apply. The sponsors
are obligated to report the value of the prize to tax authorities
as income.
No mechanically or electronically reproduced entries accepted.
The following individuals and immediate family members (defined
as spouse, IRS dependent, step or biological mother, father, sister,
brother, daughter or son) of, or who reside in the same household
as, any person in any of the following categories are not eligible
to participate:
Employees of Bit By Bit Therapy, Inc. and/or members of the Board of
Directors thereof
Employees of Main Street Title & Escrow, Inc. and The Law Offices
of Barry M. Sickles
Employees of Wittlin, Henry, Cain & Dry CPAs
Any person engaged in the development, production or distribution
of materials or prize supplied for the raffle
Any person who resides in an area where this game by chance,
would otherwise be prohibited by law.
HOW TO OBTAIN A TICKET
Tickets may be obtained online using the tab of the website.
All entrants must provide a valid email address, full legal name,
home phone number, alternate phone number, physical mailing address,
and/or mailing address. Tickets and payment confirmation will
be sent electronically via email. The raffle tickets are not
tax deductible according to IRS regulation. No refunds are available
except where noted and all ticket sales are final. Any ticket
request will be rejected if the credit card used to purchase
said ticket is not honored.
TAXES
The IRS has decided that amounts paid for chances in raffles,
lotteries, or similar drawings for prizes are not gifts, and do
not qualify as tax deductible charitable contributions. A W-9 form
must be completed by the winner. Any withholdings if required,
applicable to prize will be required at the time of transfer of
such prize to the winner. All State, Federal and local taxes associated with the receipt
of the prize, including and without limitation, all applicable
sales, use, luxury, income and special taxes are the sole responsibility
of the owner.
CLAIM OF PRIZE
Winner must claim their prize within thirty (30) days of the drawing
and sign a completed W-9 form or other forms as required by law
and the IRS. No substitutions or changes. Prize is not transferable.
No entrant need be present at drawing or tour the home to win.
Winner is determined by random drawing. Winner must produce two
(2) forms of valid picture identification to claim prize. Winner
will be notified within five (5) days of actual drawing by telephone,
mail or email. Rights are reserved to disqualify entries not in
conformity with the rules and regulations hereof.
The Sponsors are not responsible for any printing errors in any
raffle related materials or for lost, late or miss delivered or
non delivered mail or for any other failure to receive orders or
deliver receipts prior to the drawing deadline. All entries become
the property of the game and will not be returned.
METHOD OF RANDOM DRAWING (added for increased security)
Each eligible entry is assigned a unique 5 digit number ranging from
(05000-1) to (49999-1). With each 5-digit ticket number ending in “-1”.
Note: Ticket numbers with 4 digits before the “-1” will
begin with “0”.
First, five ping pong balls, numbered 0 through 4, will be placed
in a standard rotating lottery machine.
A ball will be drawn and the number noted, this will be the first
digit of the winning entry.
Then, 10 ping pong balls numbered 0-9 will be placed in the machine.
A ball will be drawn, the number noted and replaced into the machine.
This will be the second digit of the winning entry. This will be
repeated 3 more times, to correspond to digits 4 through 5 of the
winning number.
The entry that matches all five balls in order will be declared the
winner. In the event that a combination is drawn that does not correspond
with any ticket sold, the entire process will be repeated until a
winning combination is drawn. Witnesses will be chosen from the audience
to view the pulled ping pong balls. The accounting firm of Wittlin,
Henry, Cain & Dry, CPA’s, P.A. will be present and certify
the results.
SELECTION OF WINNER
The winner will be selected by a random drawing by one selected
by the certifying accountant and said drawing shall be supervised
and certified by the independent accounting firm. Entrants need
not be present to win. The winner assumes all fees and taxes as
of the date of transfer. All fees for transfer including title
insurance, closing, legal (on behalf of seller), and documentary
transfer fees shall be paid by the sponsor. There are no warranties
express of implied that accompany this prize. The home is granted
on an “as is” basis with no guaranties or warranties.
Winner must execute all required documentation to transfer title
within thirty (30) days of the drawing of the winning ticket and
notification of the winner thereof. Winner grants permission for
the use of their name and likeness/photograph without compensation
for advertising of this and similar promotions, unless prohibited
by law. In the event the winner is found ineligible under these
rules and regulations, an alternate drawing will be held within
five (5) business days of said determination and notification thereof
will be posted on the website immediately.
GENERAL TERMS AND CONDITIONS
Void where prohibited by law. By entering this drawing, the entrant
agrees to be bound by these rules and regulations and the decisions
of the sponsors shall be final. Winners will be required to execute
an affidavit of eligibility and a publicity release permitting
the raffle sponsors to use their name, photograph, likeness and
voice for promotional use and purpose in any media. All winners
are required to provide proof of identity satisfactory to the sponsor
in their sole discretion that matches the name on the winning ticket.
Neither the sponsor’s, nor any of their subsidiaries, affiliated
companies, franchises, service agencies, officers, directors, shareholders,
members, representatives, or independent contractors or any of
its affiliates are responsible for any injuries, losses or damages
of anything arising in connection with or as a result of the winner’s
acceptance or use of the prize. No purchase necessary. Winner agrees
to defend, indemnify and hold harmless any service provider and/or
sponsors and each and every one of the directors, officers, shareholders,
employees, agents and affiliates and identities from any and all
losses, damages, rights, claims and actions of any kind arising
in connection with or as a result of the winner’s acceptance
and use of the prize. If due to circumstances beyond our control
incur, including acts of God (fire, storm damage etc.), we will then
return all monies previously paid (including the transaction fees)
to the depositor with no further liability or recourse.
The raffle sponsor is We Care in Anthem 3655 West Anthem Way Ste A-109, PMB280, Anthem, AZ 85086. Bit by Bit Therapeutic Riding Center of Parkland, Florida is a beneficiary of proceeds.
ALL PERSONAL INFORMATION COLLECTED BY AND DURING THE RAFFLE WILL
BE USED FOR ADMINISTRATION OF THE RAFFLE. NEITHER THE RAFFLE SPONSORS,
NOR THE CHARITABLE ORGANIZATION BIT-BY-BIT WILL SHARE, SELL OR
OTHERWISE DISTRIBUTE PERSONAL INFORMATION COLLECTED BY SPONSOR
EXCEPT AS STATED ABOVE.
